David Leishman

David Leishman 41 came Jan 1849 as Assisted Immigrants on the Manchester, with Helen 40, Andrew 18, Agnes 13 and Sophia aged 5.
An IGI submitted entry shows David Leishman Birth: 05 APR 1800 and Christening: 06 APR 1800 son of Sophia Bell and Andrew Leishman, at Linlithgow, West Lothian.
David Leishman wed 16 Jan 1829 to Helen Grant at Dalkeith, Midlothian, Scotland. David Leishman died 1854 #5449 aged 47 from Linlithgow, parents unknown, his funeral is advertised in The Argus (Melbourne, Vic. : 1848-1954), Friday 15 December 1854, saying that his remains will leave his house at pentridge today at two oclock, to go to the new Cemetery.

Hi Elizabeth, Just reading about your Leishmans in Victoria. I am the great great grandaughter of Henry and Georgiana through their daughter Euphemia. Euphemia did marry Donald Fraser after the birth of their first 3 children, They then had Jane and Mary. Mary was my grandmother, By then the family had moved to Sydney. I have a photo of Euphemia and Donald. I sometimes wonder if the family came to Victoria for the gold rush. If so they led a hard life. I have been in touch with the family of William, they are still in Victoria and were a great help as I am no expert in family history. Thank you for listing them all.

James Leishman

James Leishman and his wife Janet Williamson, were in Collingwood when their son James was born 1854 #1330, and died aged 9 months.
Janet was expecting to be confined about the end of January, for her third child. He husband was sober when he struck her on Tuesday the 5th January.
An inquest was held by Dr Roche at the Prince Patrick Hotel, Eaglehawk, last week, touching the death of a female child, the offspring of James and Janet Leishman, began on Thurs 14 and then on 15 Jan. The father was present, in custody, during the inquiry.
Mary Ann Crowther was the first witness, she said she was the daughter of William Crowther, greengrocer. Mrs Leishman came to her father's residence and when she left asked witness to go with her. She was sober at the time, and afraid her husband would hit her. Witness went with her, and the tent was empty when they arrived, then Mr Leishman, a miner, came in and asked why there was no coffee ready for him. The beating included knocking her down several times, kicking her, and jumping on her stomach.
Caroline Fallow, a midwife, said the child was born alive, but bore a mark about three inches long, over the right loin.
Adam Dunlop, a policeman stationed at Eaglehawk, apprehended the prisoner on 13 inst, and he admitted to striking his wife.
Hugh Smith, a graduate of the University of Edinburgh and a Licentiate of the Victoria Medical Board, gave evidence of Mrs Leishman's child, which was born alive.
Drs Sorley and McDonald corraborated Dr Smith's evidence in all material pionrs and the jury returned as their verdict - that the deceased female child came to her death from premature birth, brough on by severe injuries received by the deceased;s mother, Janet Leishman, previous to her giving birth to the deceased. We are of opinion that the said James Leishman is guilty of the manslaughter of the deceased female child.
The prisoner was then fully committed for trial at the next Circuit Court. Bendigo Advertiser.

The Argus (Melbourne, Vic. : 1848-1954) Friday 1 March 1861 describes a case at the New Court House, Thurs Feb 28, 1861 before his Honour Mr Justice Pohlman, and a Special Jury of four, Farmer V Leishman and Another, Mr Higinbotham with Mr Dawson for the plaintiff, Mr Billing for James Leishman, and Mr Wright for Alexander Leishman.
The plaintiff, a publican at Kerang on the Lower Loddon, wanted to recover 309 pounds, the amount of a promisory note given 28 Dec 1859 in the name of "Leishman Bros" and signed by James Leishman.
In evidence, James Leishman had come out to the colony under the name of Wilson, and went into business with a person named Hill, and the goods were supplied before Alexander Leishman arrived at the end of May, 1859. He said he married at home without his parents consent, and his father sent him out 500 pounds, with Alexander Leishman. He then resumed his proper name.
The jury was absent 25 minutes then found a verdict for both the defendants.
